Al Mustapha Is Innocent........Fani Kayode


As far as I am concerned, based on the evidence that was adduced in court, this man had absolutely nothing to do with the killing of Kudirat Abiola

When I heard that Major Hamza Al Mustapha was convicted of murder and sentenced to hanging by a Lagos High Court yesterday afternoon I was utterly shocked, saddened and disgusted. And let me tell you why. I

was one of those that opposed the late General Sani Abacha's government and fought against Al Mustapha and co. with every fibre of my being during the NADECO days. Given that, if anything, I should have been rejoicing with the many other NADECO leaders, supporters and stalwarts who honestly believe that Al-Mustapha actually ordered the death of our wonderful heroine Alhaja Kudirat Abiola and who believe that he deserves to die as a consequence of it.
However I am not rejoicing with them simply because as far as I am concerned, based on the evidence that was adduced in court, this man had absolutely nothing to do with the killing of Kudirat Abiola. I believe that whatever we do we must always operate within the law and there is no place for the expression of unfettered emotions, vendetta or jungle justice in a civilised country when it comes to the administration of justice. I have been following this case closely for the last four years and I have publicly called for the release of Al Mustapha on a number of occasions simply because I found it shameful and unjust that the state could lock up a man in a dungeon for 13 years without being able to prove a case against him.
By doing that, they have already almost ruined his life yet there is a presumption of innocence in our law. Now the state has gone even a step further in this whole unsavoury and disgraceful episode and they have convicted a man to hang for something that he knew nothing about simply because they want to silence him and stop him from exposing the truth about the role that many of the high and mighty played in the death of Abacha, MKO Abiola and many others. They want to jail and kill Mustapha just as they have jailed and killed so many other innocent men that came before him. Let me make this clear- I hold no brief and I have no sympathy whatsoever for the Abacha government that Al-Mustapha served and neither do I seek to defend their actions whilst in office.
The truth is that they committed many atrocities and till today many find it hard to forgive them for those atrocities. Many of our people in the south-west were killed, locked up and driven into exile by that government as was the late General Shehu Musa Yar'adua and many others from other parts of Nigeria. I myself had to leave the country and go into exile in Ghana in 1996 because of them and I never thought that I would ever return to Nigeria again. Yet, despite all that, I cannot allow my bitterness and anger with the Abacha regime to becloud my reasoning and sense of justice that I would support or applaud a case of what would essentially be judicial murder.
Yes Abacha's government and even Mustapha himself, as a consequence of his unflinching loyalty to his boss, committed atrocities and violated the rights of many but does that mean that we should do the same to them? Do two wrongs make a right? Are we all to descend into the pit of slaying the innocent and punishing their families simply because we must have our pound of flesh and even where there is no tangible evidence to justify such a course of action? I challenge those that doubt me to look at the evidence and to study the judgement closely as I have done. It is wickedness and it is a travesty of justice. Worse still it sends the wrong signal to an already tense nation that is fraught with regional, north/south and christian/muslim tensions. This absurd judgement could not have come at a worse time and I have little doubt that the Boko Haramites amongs us (whether it be the overt or covert ones) will make quite a song and dance of it.
Thankfully Al Mustapha has the right to appeal but the implication of that is that this man's enemies have virtually destroyed his life already and left him with no hope because, unless he is granted bail pending that appeal, he will be struggling with it from the dingy dungeons of Kirikiri prison all the way to the Supreme Court for the next ten years. That is the Nigerian state and ''system'' for you. When you are loyal to your leader, when you speak out in his defence, when you defend him with your life and when you tell the world the truth they come at you with everything that they have got and seek to jail or kill you for it once that leader is no longer in power or is no longer alive. One thing is clear though- those that seek to hang Al Mustapha and silence him forever have forgotten the God factor. They have forgotten that there is a God of justice and mercy who still rules in the affairs of men and who forges the destiny of nations.

For my old adversary and new friend Major Hamza Al Mustapha I will not beg any mortal for mercy and neither will I plead for him. I will only pray to the Living God that if truly this man is innocent, as I earnestly and honestly believe that he is, then he should be eventually freed and completely vindicated. This is especially so because something tells me that our country will still need him. God's ways are not ours and only He sees and knows the hidden things that lie ahead. It is not Al Mustapha that we should weep for, it is Nigeria.

Finally let me restate my position clearly for all to see and for posterity to take note of. I believe that Hamza Al Mustapha is innocent of this crime. As far as I am aware there is absolutely no evidence against him and the only person that said that he ordered him to go and kill the late Kudirat Abiola (Sergeant Barnabas Jabilla) has long since recanted and said that he was induced and compelled to give that false evidence by the authorities. In any civilised country that would have been the end of it but not in Nigeria. In Nigeria it is a case of ''we must get him at all costs'' even if it means bending the law and influencing the courts. One has to ask whether, as a people, we have any fear of God? Is there any justice in Nigeria? Is there any fairness? Can we ever rely on the courts to do the right thing when the state determines to punish an innocent man for his perceived sins against the powers that be?

I am fed up and disgusted with the sort of things that go on in this country when it comes to such matters and I just cannot understand how Nigerians are so comfortable with such injustice and wickedness being meted out to their compatriots. Do they not know that tomorrow it could be them or a member of their family? On this matter I stand by Al Mustapha shoulder to shoulder just as I do with every other innocent person that has been unfairly charged to court for political reasons and who has suffered persecution at the hands of a relentless and vicious state that have no fear of God.

This country just has to change. God's wrath is stirred up by such wickedness and insensitivity. You lock up an innocent man for 13 years in the most horrific conditions for something that he did not do, you delay his trial, you wrongly convict him where there is clearly no evidence to justify it and now you want to hang him? God is not asleep Nigeria. Unless God wills it, Hamza Al Mustapha will not hang and ultimately he will be vindicated. My prayers are for him and for his family at this difficult time. God bless Nigeria. 








     




 










Nah Wah Oh!!! Woman Marries Building


The Los Angeles Times reported Monday that Baylonia Aivaz, an activist with Occupy Seattle, exchanged vows Sunday afternoon with an old warehouse slated for demolition.
Spokane's KXLY reported that Aivaz and the warehouse located at 10th and Union on Seattle's Capitol Hill "entered into a self-described “gay marriage,” surrounded by friends singing of love and united against displacement in their neighborhood by means of new development."
Seattle's KING 5 said the activist "fell in love with the 107-year-old building during an Occupy Seattle protest and doesn't want to see it torn down to make room for a brand-new apartment building."

KXLY noted that Aivaz and 16 other Occupy Seattle protesters "linked arms and occupied the warehouse to fight against gentrification and for community space."
"I hope that America wakes up and

realizes that gentrification is a serous issue that affects poor people, especially people of color, and we really need to stand up and do something about what's happening in our neighborhoods all over the country," Aivaz said.
"When I look at this building I see a community center, I see a community art space, i see a homeless shelter, I see free childcare, I don't see a building, I see a space that can address all the needs of our neighborhood.”
KXLY added:
When the minister asked if she would “love and cherish and protect this warehouse,” Aivaz responded in song.
“Come with me my love, to the sea, the sea of love. I want to tell you how much I love you,” Aivaz sang, quoting “Sea of Love” by Cat Power.
“Do you remember when we met? I cleaned your rooms and washed your floors, built community, opened some doors. You changed my life. I’ll never forget the day we met. I’ll cherish your community sprit until the day I die,” she said, adding her own verses.
The ceremony continued with the calm but ecstatic guests singing “Lean on Me,” laughing at children blowing bubbles and enjoying a neighborhood potluck with a vegan cake.
But the characterization of the vows as a 'gay marriage' have some upset, considering that Washington is on the verge of becoming the seventh state to legalize same-sex marriage.
As Aivaz pledged her undying love for the building, gay marriage proponents protested nearby with signs reading “This is not a gay marriage."
Phoenix Lopez, one of those quietly protesting the marriage, said she found Aivaz's description "disrespectful.”
Aivaz did not disclose her honeymoon plans, but her union with the building will be short-lived, as demolition is already underway, according to KING 5.

A Nigerian born Canadian man accused of masterminding one of the largest high-tech bank robberies in U.S. history was sentenced to nearly 18 years in prison Monday following a years-long investigation into fake debt collection agencies that prosecutors say stole the identities of about 38,000 people.
Adekunle Adetiloye was accused of organizing a scheme to open nearly 600 fraudulent bank accounts and bilk 22 major banks, potentially costing credit card firms and banks up to $5 million. Assistant U.S. Attorney Nick Chase in North Dakota, where the case was handled, said the 40-year-old had an "insatiable hunger for other people's money."
Defense attorneys had argued that their client, the only person charged in the case, was a "marginal and minimal participant" whose role was to handle mail and withdraw money from ATMs. But prosecutors and the judge believed he was central to the scheme.
Investigators said Adetiloye incorporated two different companies in Delaware — Syspac Financial Services and Commet Consultant Inc. — that claimed to be debt collection companies. He gained access to commercial data providers, including large-scale outfits LexisNexis and ChoicePoint that only allow access to law enforcement, financial services and debt collection companies.
 
With access to those data providers, Adetiloye and others obtained the personal identification information to about 38,000 people, most of whom were

medical professionals, and used that information to open credit card, debit and checking accounts, prosecutors said.
Those data providers said it was only the second such breach of that scale.
"Characterizing this fraud scheme as massive, if anything, is an understatement," Chase said in court documents.
Investigators' interest in Adetiloye, a native of Nigeria, was piqued after figuring out he was unemployed and receiving welfare yet living lavishly, complete with a Range Rover vehicle, extended trips to England and an expensive condominium. Then there were two credit cards tucked away in his wallet the each bore different names — Donald Douglas and Vincent Andriole — that seemed to confirm suspicions that he was up to something nefarious.
The complexity of the scheme — which took five years to investigate and litigate — was highlighted in a sentencing phase that has lasted nearly a year and included numerous hearings and briefings, and some 12,000 pages of court documents. The case wound up in North Dakota after U.S. Bank's customer service center in Fargo intercepted calls by Adetiloye and others.
U.S. District Judge Ralph Erickson handed down a 214-month prison term and scheduled a Feb. 15 hearing to discuss returning nearly $1.5 million in losses to credit card companies and banks. The judge has said losses may have been as much as $5 million.
Defense attorney Richard Henderson had asked for a sentence of fewer than 16 years for his client, who pleaded guilty to mail fraud charges. Henderson said any prison time is more difficult than it would be for American citizens because he has no family in the United States. No decision has been made about whether he plans to appeal, said Neil Fulton, lead federal public defender for North Dakota and South Dakota.

Nah Wah Oh!!! 3 Year Old Boy To Undergo Surgey To Remove His Twin Sibling From His Stomach


Sometimes you hear some stories and you can't help but thank God for his mercies, for good health and everthing you have. Other times you can't help but to pray for others and that is exactly what this little boy needs.

Doctors in Peru said they would operate today on a 3-year-old boy to remove the body of his would-be twin.
Isbac Pacunda has the body of his twin inside his stomach – bones, eyes and even hair on the cranium. Dr. Carlos Astocondor, a plastic surgeon at the Las Mercedes Hospital in Chiclayo, told the Associated Press that the partially formed fetus weighs about a pound and a half and is 9  inches long. He and a team of 12 doctors will surgically remove the tissue from the boy’s stomach today.
The condition is called fetus-in-fetu and happens in about one  out of every 500,000 live births, Astocondor said. Although rare, these cases are not unheard of. In 2008, doctors removed a 2-inch embryo from the body of a 9-year-old girl in Greece. In 2006, doctors found a half-formed twin with limbs, genitalia, hair — even fingernails – in the swollen stomach of a

The case spotlights the biological precision needed for twins to develop in the womb. Identical twins form when an egg splits in half right after fertilization. If the egg fails to fully separate, conjoined twins will form, sharing some portion of their bodies.
Dr. Jonathan Fanaroff, a neonatologist at Rainbow Babies and Children’s Hospital in Cleveland, told ABC News that some conjoined twins can live as “parasites,” relying on the body of the other for a blood supply and organ function. But for fetus-in-fetu, the body of one twin envelops the other during development.
“In this kind of situation, because it was inside the other boy, it wasn’t able to survive,” Fanaroff said.
Surgery to separate live, conjoined twins is extremely difficult and fraught with ethical complications. Fanaroff said the removal of Pacunda’s twin will likely be much easier.
